Brock Lesnar’s Attorneys File Motion to Dismiss Mark Hunt’s Lawsuit

March 24, 2017 | Posted by Jeremy Thomas

Brock Lesnar’s legal team has some strong words in response to Mark Hunt’s lawsuit against him. MMAjunkie reports that Lesnar’s lawyers have filed a motion to dismiss the lawsuit, strongly refuting Hunt’s claims that Lesnar participated in a conspiracy in regard to his fight with Hunt at UFC 200.

The thirty-page response sees the Lawyer’s scoff at Hunt’s legal claims, arguing that Hunt is trying “to convert a positive test for trace amounts of a banned substance…into a scheming RICO claim.” It goes on to say the suit “fails miserably, float[ing] on a sea of bombast” and asks that the suit be dismissed without the option to refile. It argues, “Plaintiff’s complaint is so devoid of any facts to support his RICO and fraud claims that it would be almost impossible for Mr. Lesnar to respond.”

Hunt filed the lawsuit after Lesnar beat him at UFC via unanimous decision, only to test positive for banned estrogen blocker clomiphene twice in relation to the bout. Hunt was livid about the fact that the UFC and USADA failed to expedite the first test, allowing Lesnar to participate in the fight, and demanded that he receive Lesnar’s $2.5 million purse. The UFC declined and Hunt suit Lesnar, Dana White and the UFC.

The motion states, “Plaintiff’s RICO claim is so incredibly deficient as to defendant Lesnar, that it is difficult to know where to even begin. As an initial matter, plaintiff lacks standing to bring this claim, because he does not even allege the type of injury that is covered by the RICO statute. Furthermore, as to defendant Lesnar, the complaint fails to plead long-term criminal activity, fails to plead a predicate act, fails to adequately plead intent, fails to adequately plead fraud, fails to adequately plead false pretenses, fails to adequately plead the requisite pattern of activity, and fails to adequately plead a conspiracy within the meaning of the RICO statute.”

White and the UFC also filed a motion to dismiss previously. The motions expected to be heard in a hearing on May 15th.
