Jared Fogle Seeking to Get Prison Sentence Tossed Out

Jared Fogle has written a motion to have his prison sentence thrown out, arguing that the judge who accepted his plea didn’t have jurisdiction. TMZ reports that the motion, which Fogle penned personally, argues that he should not have been charged with conspiracy due to the fact that conspiracy does not apply to the crime of distributing sexually explicit pictures of minors.

Fogle has served just over two years of his fifteen year, eight month sentence so far after pleading guilty to the charges against him.

Fogle also argues that his guilty plea on charges of traveling in interstate commerce in order to engage in unlawful commercial sexual acts with minors should be vacated because he didn’t go out of state in such a manner and claims he had no involvement in making of pornographic photos of children.
