Judge Denies Motion to Dismiss Russell Simmons Rape Lawsuit

The lawsuit filed against Russell Simmons over rape allegations will move forward, as a judge has denied his request to dismiss the suit. The Blast reports that the judge in the case shut down Simmons’ motion to dismiss the suit.

Simmons was sued earlier in the year by a woman over an alleged rape in 1988. He filed a motion to dismiss the suit on the grounds that his accuser did not provide specific dates of the incident, but the judge ruled that “the elements of the three claims (forcible rape, intentional infliction of emotional distress and negligent infliction of emotional distress) do not require a date of the incident.”

A hearing in the case is set for next month. This is one of a couple of lawsuits Simmons has had to deal with over sexual assault claims; the first was dismissed with prejudice in April, with Simmons’ rep declining to comment on questions whether the case was settled.
