One of the lawsuits filed against Russell Simmons alleging sexual assault has been dismissed. The Los Angeles Time reports that the suit was dismissed on Wednesday with prejudice, meaning that it cannot be refiled.

Jennifer Jarosik sued Simmons for $5 million claiming that Simmons invited her to her home to discuss her documentary film in 2016, but became aggressive and assaulted her after she turned down his sexual advances. Simmons had denied the allegations.

A representative for Simmons declined to comment, and did not respond to a question regarding whether a settlement had been reached. Lawsuits dismissed with prejudice without a stated reason are often done so due to settlements.

Simmons still faces a $10 million lawsuit from an unidentified woman who claims Simmons raped her in his hotel room after a 1988 concert.
