Motion Officially Filed to Dismiss Oliver Luck vs. Vince McMahon XFL Lawsuit

The settlement in the lawsuits between Oliver Luck and Vince McMahon over Luck’s XFL termination is moving forward, with the motion to dismiss officially filed. As reported earlier this week, a settlement has been reached in the lawsuit that was originally filed in April of 2020 after the XFL shut down. Luck had alleged at the time that McMahon wrongfully terminated his contract, while McMahon countersued.

A motion was filed on Thursday in the lawsuit in which Luck, McMahon, and McMahon’s Alpha Entertainment (also named as a defendant) stipulated to dismissal of both lawsuits with prejudice, which means that it cannot be refiled.

The XFL is now owned by a group that includes The Rock, with a relaunch set for next year. The filing reads:

STIPULATION OF DISMISSAL WITH PREJUDICE
Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), Plaintiff Oliver Luck (“Luck”) and Defendants Vincent K. McMahon (“McMahon”) and Alpha Entertainment LLC (“Alpha”) (collectively, “Defendants”) hereby stipulate to the dismissal of this action with prejudice as follows:

1. Luck’s claims against Defendants in this action shall be dismissed with prejudice and without fees or costs to any party.

2. Alpha’s counterclaims against Luck in this action shall be dismissed with prejudice and without fees or costs to any party.
