Judge Denies Motion By Ludwig Kaiser For Dismissal In Battery Case

Ludwig Kaiser will not get a dismissal in the battery case against him just yet, with a judge denying the motion to dismiss today. F4W Online reports that the judge in the case over Kaiser’s altercation with a man at his apartment complex denied the WWE star’s motion to dismiss the case during a hearing on Monday.
As previously reported, Kaiser was arrested in April after the incident, which took place in an elevator in the Orlando, Florida apartment complex. He was charged with misdemeanor battery in the incident, in which he allegedly shoved and hit Richard Reap. Kaiser and his partner Andrea Bezarte were being “affectionate” in the elevator and Reap alleges he told the couple to “please have some manners.” Kaiser says Reap swore at them and made a racist comment, threatening to call ICE on Bazarte. Kaizer says he pushed Reap but only after Reap came aggressively toward him, and claims he didn’t retaliate when Reap threw a soft drink bottle at him.
Kaiser argued that his use of force was justified under Florida’s “Stand Your Ground” law and that he believed it necessary to protect himself and Bazarte from “imminent use of unlawful force.”
A pre-trial conference in the case is scheduled for December 17th.
