TNA Files Lawsuit Against Gail Kim Over Alleged Whistleblower Threat

TNA has reportedly filed a lawsuit against Gail Kim after she allegedly made a whistleblower threat against Anthem. PWInsider reports that TNA’s parent company Anthem Wrestling Exhibitions filed suit against Kim on January 10th before The Nashville Chancery Court in Tennessee. The lawsuit comes after Kim allegedly informed the company following her exit in March of last year that she “believes she holds legal claims against AWE for violations of the Florida Private Whistleblower Act.”\

Anthem Wrestling Exhibitions is a subsidiary of Anthem Sports & Entertainment. The specifics of the alleged violations are not listed in the lawsuit, which Anthem filed alleging that all issues between the two should be governed by Tennessee law and should not be subject to the Florida whistleblower law.

The lawsuit provides some background, noting that Kim signed a contract with the company in September of 2022 for a job that included “talent relations, match production, and performer services.” and to “identify and support new revenue, business, and growth opportunities for AWE.” That deal concluded at the end of 2024 and the two sides agreed to continue on a month-by-month bases from there.

Kim was considered an independent contractor at that point and was non-exclusive, with the ability of Kim to provide services “to other customers” with some limitations such as not providing wrestling services to any competitors.

The suit notes that Kim worked mainly in talent relations and production, worked from home and did not work for the companty full-time. At that time she was working in other “independent projects” such as The Amazing Race Canada and The Traitors Canada. It goes on to say that Kim’s relationship with the company ended in March when Anthem made a “strategic decision to restructure.”

Anthem argues that as Kim was an independent contractor, she has no “legally cognizable claims” against them based on Florida law. They are asking the court to declare that all disputes between Kim and Anthem be governed by Tennessee law, and that she cannot assert claims against them for alleged violations of Florida state statues.

They are also asking the court to confirm that Kim an independent contractor, thus negating any of her claims that she “has threatened to bring under the Florida Private Whistleblower Act, the Florida Civil Rights Act, and Title VII of the Civil Rights Act of 1964.” Finally, they are seeking an award for reasonable attorneys’ fees and court costs.

There is no note as to whether Gail Kim has been served with the lawsuit, and no court dates listed on the case docket.
