Update on WWE, ESPN, & BAMTech Lawsuit, Court Rules in WWE’s Favor of Halting Arbitration

As previously reported, ESPN and subsidiary BAMTech were added to the lawsuit over WWE premium live events migrating to the ESPN App. PWInsider has an update on the ongoing lawsuit and a new motion in WWE’s favor today.

The U.S. District Court in Connecticut ruled in favor of a WWE motion to halt discovery against WWE, ESPN, and BAMTech, LLC. The lawsuit alleges that WWE misled customers about how to watch its major PLEs after moving them to the ESPN Unlimited tier of the new ESPN App starting with Wrestlepalooza 2025 last year.

Discovery is the phase where both sides are required to bring in evidence and open up records to each other. WWE, in its motion, argued that discovery should be halted until the court rules on the existing attempts from the defendants to move the lawsuit to private arbitration. PWInsider notes that there’s currently no time limit for the court to issue a ruling on whether the case will be moved to arbitration or not.

The lawsuit was filed earlier this year by Michael Diesa and Rebecca Tobak. As noted, ESPN and BAMTech are pushing for the lawsuit to be added to arbitration. The plaintiffs are asking for a jury trial.
