Ted DiBiase Jr. Reportedly Denied Latest Motion To Declare a Mistrial in Federal Court Case

As previously reported, the federal trial of former WWE Superstar Ted DiBiase Jr. resumed earlier this week, with the former WWE Tag Team Champion facing charges related to the Mississippi welfare fraud scandal following an April 2023 arrest. PWInsider has the latest update on the case.
The United States District Court of the Southern District of Mississippi (Northern Jackson) reportedly denied DiBiase Jr.’s attempt to have a mistrial declared. This is the second time a mistrial was attempted to be declared and overruled.
Ted DiBiase Jr., the son of WWE Hall of Famer Ted DiBiase, had previously attempted to have the trial thrown out since his primary attorney, Jason Scott Gilbert, was dealing with a “sudden, medical incapacitation,” and was unable to continue the trial. The trial was later paused and resumed this week, but Gilbert is still unable to represent DiBiase Jr. presently due to his illness.
It’s noted that in a second motion, DiBiase’s legal counsel, Eric Herschmann, explained that Gilbert’s doctors haven’t yet determined if his medical condition will prevent him from proceeding with the trial. Herschmann also stated that he was retained pro bono for a narrowly defined purpose, to handle one specific witness, and possibly a second, depending on the schedule during limited dates.
During the court’s proceedings on Wednesday (Feb. 25), the court denied the latest mistrial motion. Details aren’t available yet on why the court made that ruling.
