Alleged Liv Morgan Stalker Makes New Bid For Pre-Trial Release

The man accused of stalking Liv Morgan has filed a new motion in his request to be released in the leadup to his trial. As previously reported, Shawn Chen was denied a motion to be released on bond as he awaits trial. The court denied Chen’s request, noting that his lawyers having secured him a place to stay at a local Salvation Army did not significantly change the circumstances and that Chan was determined via a psychological evaluation to have a “delusion regarding” Morgan, putting her at risk should he be released. PWInsider reports that Chan filed a new motion seeking to revoke the order keeping him detained, and a hearing is set for September 26th.
Chan’s lawyers argue in the motion that the government “failed to show that Mr. Chan is a serious risk of flight or that no combination of conditions of release could “reasonably assure” his appearance as required, and the magistrate judge erred in considering the danger to the safety of the victim posed by his release.”
The argument states that Chan lawfully entered the US, has no criminal record or past drug/alcohol issues, and no failures to appear in court. It does on to say that he has no incentive to dodge future hearings because if he is deported, that would mean he’s being sent home which is where he would go anyway. They also argue that the charges against Chan are not of a violent nature, not related to terrorism, not a sex crime, and not drug or weapon related, and that nothing related to the charges suggest that Chan would flee to avoid being prosecuted.
Finally, the defense team argues that the government must prove that Chan intended to harass or intimidate via the charges filed, but that his delusional disorder that he is friendly with Morgan undermines the notion of intent to do so. The motion states that the evidence’s weakness gives Chan incentive to appear and contest the charge, and that Chan’s mental illness is “treatable” which means the Court could impose treatment as part of his condition of release, as well as the requirement of a location-monitoring device and a stay-away order to maintain Morgan’s safety.
Chan was arrested and charged with a count of interstate domestic violence after he allegedly traveled from Canada to Orlando, Florida where, after claiming he was headed to the WWE Performance Center, went to Morgan’s home on May 31st, and attempted to gain entry. He was arrested in June 3rd and indicted on June 25th, and faces up to five years in prison.
