Plaintiff Files Appeal In WrestleMania 38 Injury Lawsuit

An appeal has been filed regarding the dismissal of a lawsuit filed by a WrestleMania 38 attendee against WWE over injuries sustained at the event. As reported last week, the United States District Court for the Northern District of Texas, Fort Worth Division dismissed the lawsuit filed by Marvin Jackson over allegations that he lost hearing due to pyrotechnics at last year’s PPV. The dismissal agreed with WWE’s motion requesting that the case be taken to arbitration and dismissed the suit with prejudice, which meant that that the case cannot be re-filed again within the same court.

According to PWInsider, Jackson has filed an appeal over the decision, though the filing didn’t list the grounds upon which Jackson is basing the appeal.

The lawsuit was seeking over $1,000,000 in relief including all damages, penalties, costs, expenses, prejudgment interest, and attorney’s fees.
