WWE, Cody Rhodes & Fanatics Reportedly Settle American Nightmare Lawsuit

WWE, Cody Rhodes and Fanatics have reached a settlement in the lawsuit over the “American Nightmare” trademark. As previously reported, Wesley Eisold, the frontman for the band American Nightmare, filed suit against the parties in September 2024 alleging trademark infringement as well as breach of contract and deliberate interference with contractual agreements.
POST Wrestling reports that a settlement has been reached in principle in the suit. The parties to the lawsuit informed the court on Tuesday that they’ve agreed to resolve the case. The settlement agreement has yet to be drafted and executed at this time. The filing notes that they expect to file a formal request to dismiss within 90 days.
Eisold argued in the suit that WWE, Cody Rhodes, and Fanatics violated their agreement with him. He argued that sold merchandise with “American Nightmare” but little to zero reference to Rhodes as a wrestler, which caused the breach. He sought $150,000 in damages, plus treble damages of up to $300,000 for federal trademark infringement, plus attorneys’ expenses.
